Then, I had to get to work and unfortunately my insane ADD/overachiever mentality has really caused my summer to EXPLODE into what could actually be a busier time period for me than the school year was.

WTF!?!?!

No, seriously.  First, I was blessed from the law GODS with a Judicial Externship!  YIPPEE!!  I work for a judge in Chicago who really takes his mentoring role seriously.  He gives us a ton of substantive writing and will personally help us re-write our work to not only produce something that gets posted to the state record but will actually be a really great writing sample.  I couldn’t be more thrilled!!!  Watching the court in action is really cool too!  Just seeing how these lawyers work knowing one day in the not too distant future that will be me up there arguing for/against that motion to dismiss, etc… AWESOME!!!!

Now, admittedly, I am a law geek!  I enjoy what most would consider the mundane.  I find researching case law and Shephardizing cases interesting!!  (look it up!!)    :)  Kidding!  For you 0Lers, Shephardizing is what you do to a case to make sure it is still good law – done in Lexis (or maybe Westlaw – not sure – don’t use it!)

But, I digress…

Now, I applied for this externship in January so by April when I still hadn’t heard back about the job, I applied for a clerk position with the State’s Atty office by my house.  Not only was I insanely excited at the prospect of working within 15-20 minutes from my house but it was working with the person who handles employment law (which is what I am interested in) so I really was hoping for this job.

Well, right after I accepted the position with the judge (which was only 2 days a week***see below) I was brought in to interview for this job.  My intention was to gain interview experience but in the unlikely event that they wanted to hire me too I’d simply decline.  Well, damn it if I didn’t want the job MORE after the interview!!!!!!!!!  I interviewed with a few different people.  It seemed like the perfect job for me!  He said he was hoping if we all liked each other that I’d come back next summer with my 7-11 license (no, seriously, look it up!!!!) and he’d have me in court all day (!!!!!) and then again if we all liked each other he’d want to hire me after graduation!!!!!  He then started selling the place to me – coyly mentioning that the age group in the office was similar to my age.  Most of the people had young children like I do and most people only worked 9-5ish.  He said it wasn’t cutthroat or competitive.  It sounded like the IDEAL job for a mom with young kids!!  I kept thinking I could work there while the kids were young and then if I still had the desire for big firm money, I could take all my experience and apply downtown.

WOW!!!!!!  I mean how could I say no, right????

Plus, they were willing to work around my externship!!!!!  Seriously?????  :)

So, that brings us back to the trial team.  After making it (YEA!!!!) I decided to take Evidence this summer so I could take the trial advocacy intensive class in August.  That trial ad class goes 8 straight days and does the whole semester in the week!!!  Supposedly it is THE way to take the class – especially if you are on the trial team.

AND…….

Since I received the externship, I could take it for class credit and get me out of taking one semester of legal writing so of course, right?!?!  Well, it requires class one day a week with extra assignments!!!!!!!!

So, to recap – Judicial externship, law clerk for state’s atty office, 2 classes, AND let’s not forget my regular, paying, part-time job!

AND…

Because in like February I was worried I wouldn’t have a summer internship (0L tip of the day – PLEASE do not panic in FEBRUARY about not having a summer job!!!  WAY too DAMN early!!!), I asked my boss (who runs a political organization in Washington DC) if I could come there and she could hook me up with the lawyers that work for the org.  Being that she is very sweet and generous she said sure.  So, when class is over (July 20th) I will spend 2 weeks in DC interning with this organization and working with the lawyers who keep it afloat.  Pretty excited about that because the lawyers are actually part of a firm notched high up in the Vault 100 (top 100 firms in the country?  world?  not sure – look it up and let me know!!  LOL!!) and as you may know, my dream job is litigation at a big firm so getting experience working with one of them/making connections would be nice!  That job goes from the end of July until 2nd week of August.  Externship and law clerk jobs end at end of July.

So, I will have exactly one week when I get back from DC before the trial ad intensive class begins and then classes begin right after that!

WHEW!!!!  I’m exhausted just writing all of that!!!  :)

Now, please don’t misunderstand – I am by no means bragging!!  This is a cautionary tale!!  Having one of those jobs would be great on a resume.  That is ALL one needs to do their 1L summer – have something decent to put on the resume!!  I was thinking how great that externship would be on a resume without realizing how much work it entails!!!

***as I stated earlier the externship was only supposed to be 2 days a week but since I am taking it for class credit I need to put in 32 hours a week!!  So, the clerk gave me an assignment that is huge and has a short deadline because she believes I will be working 2 days a week from home!!  You do the math:  2 days/wk externship, 2 days/wk clerk at state’s atty office, 2 classes, part-time job – I don’t have 2 days/wk at home to do the judge’s writing!!!!!!  :(

So, I am BACK to staying up late at night writing!!

But what a great resume I’m building!!  LOL!!!  And the funny thing was, if you talk to anyone who knew me 10 years ago and asked them to list 50 traits about me – overachiever would NOT make the list!!!  :)  Where did THIS come from!?!?!?

So, now I am writing trial memos like the ones we did earlier in the Spring semester only this time it is for real.  This time the people filing the motions are real and so is the outcome. And my job is to research it and give the judge my opinion about which way he should rule.

NO JOKE!!!  SURREAL!!!

(Here we go again – and with my last final, Legislation, in less than 24hrs and me NO WHERE NEAR prepared, I was not in the mood)

I am beat!

I’ve had probably a combined 12hrs sleep in the last WEEK!!!

I have eaten soo much crap, my face has broken out like a 15 yr boy!!!

My carpel tunnel has caused my entire right arm to be ON FIRE and virtually useless!

My house/car are so disgusting I fear I may end up on the show “Hoarders”!!!!

On a positive note, my Property exam went as well as could be expected.  I don’t want to say I left feeling good but I did not leave feeling bad so that is certainly an improvement!!  :)

I ran out of time again but at least this time I came very close to finishing.  I answered most of the questions thoughtfully and when I was not right, I hope I got points for at least explaining why I SHOULD be right!

So, not bad after panicking and blowing Civ Pro!  And not bad after fearing the panic would occur again soo much that my outline morphed to 146 pages!!!!!!!

Yes, that’s right peeps – 146 pages!!

I was soo afraid that I would not have the information I wanted that I put everything in there!!!  I also had sample answers to potential questions.  I had sample future interest/RAP problems with answers.  I had the same information in chart form.  I also had a definition sheet in there.  It was all tabbed so I never really felt overwhelmed by it.  I DO wish I had more memorized because that is the ONLY reason I ran out of time.  But, when all is said and done, it was at least organized (which was a big complaint from last semester Profs) so I feel 100% better about that.

Now, I move on to Legislation – my favorite subject matter and most boring class!  Hopefully that will translate in to an outline/final that work well!!!  I would love to end my 1L career on a high note!!!

At least I’ll get some sleep soon!!

Seriously, 0L tip of the day:  forget doing anything fun over Christmas break if your Spring semester classes are Civ Pro and Property because ALL you should be doing is reading a hornbook and a supplement to try and grasp as much of the information BEFORE class as you can!!!!!!

I say this about Property ESPECIALLY for those of us who loved the idea of law school because we suck at  hate math!!!  We thought there’d be very little math, right?  Maybe a tax class or business organizations (maybe) but really how many of you 0Ls thought you were finally done with the math problems or GOD FOR FREAKING BID the logic problems?????  Well, you were wrong!

I’m going to take about 2 minutes out of my busy studying to have you read this example from my SUPPLEMENT on how to do a Rule against Perpetuities question.  I stress supplement because this is the book that is suppose to HELP me better understand RAP…

Here we go – first the question and then the explanation on how to analyze the question:

In 1990, O conveys “to A or his heirs for the life of X, remainder to the oldest child of A living at X’s death who has a child who has graduated from a 4-year college.”  In 1990, A has only one child, B, who has a child, C, who was born in 1976.  A never has any other children.  In 1998, C graduates from Harvard.  In 2000, X dies.  You have to decide whether the gift to B is valid under the RAP.

(and the answer my supplement gives to “help” me):

Now, viewed from the moment of the conveyance in 1990 (and under the common law we always have to evaluate the possibility of an RAP violation as of the moment of the gift, not based on how things actually turn out), it is possible that:  1) C will never graduate from college; 2) B will have no other children; and 3) A will have a child born after 1990, call her D, who will in turn have a child, call her E, who will graduate from college, but not until more than 21 years after the death of X, our measuring life.  (D can’t be a measuring life because she hasn’t been born by 1990, the time of the conveyance).  Therefore, under the common-law the gift to B is void, even though in the actual event it turned out that C graduated (and B thus qualified for the gift) well before X’s death.

Interesting thing about those blawgs – they are literally the two I read A LOT before law school and absolutely the reason I am blawgging today!

For those of you who are new, I decided to blawg as a sort of 0L place to go for what life is like in law school.  That hasn’t worked out too well as of late but I do have the occasional “0L tip of the day” with random things every 0L MUST know.  Usually it’s about some misconception they likely believe that I want to make sure and dispel before they get here – 1L HELL!!

So, yes, Huma and Dennis are awesome and EVERYONE should read them regularly!!  I in fact follow them on twitter @huma_rashid and @dennisjansen.  Both are very sweet and tweet awesomely funny and insightful thing!

So, I know feel major pressure to not be ignorant!  No more posts of half-naked guys and Betty White riding on a horse that is actually John Ritter!!!!  :)

That is all I have to say about her!  And to anyone who thinks like her I say FUCK YOU TOO!!  I’m sick to DEATH of people attributing intelligence to a race (and that includes saying Asians are pre-disposed to being smarter)!!!  As the article suggests, I TOO am of the nurture over nature type of person - believing that the right environment can have a child do anything!!!

And I hate the righteousness of some people in some races!!!!  This is about white people pissed off with companies, schools, government offices, etc looking to improve on their diversity.  GOD FOR FREAKING BID people actually try to recruit people who will bring a more diverse experience to the place!!!  And I simply HATE the people who want to explain why blacks are even at a school like HLS!

For Christ’s sake, I’ve heard assholes say President Obama is an affirmative action baby and that is how he got into HLS – knowing NOTHING about his LSAT scores, etc!!!!

Hell, here at my school I’ve heard people say that certain people on the Trial Team are only there because they are black and will be put on the BLSA team and that is unfair to make spots for a black team when they weren’t good enough to make the “real” team.

But no – that’s not racist a thing to say at all!!!!

So apparently getting in trouble for talking too much in grade school and high school, always wanting to win an argument as a kid, and watching a gazillion hours of Court TV and law tv shows pays off…

Seriously, tho – I always kinda knew I wanted to be a litigator and being an older student I felt like my age would automatically give me some kind of credibility in the eyes of a jury simply because they won’t misjudge me like many do with young people (even tho I will now have to be that much better because they will automatically assume I’ve been doing this awhile!!)  But, I just felt like the courtroom was the one place an older student would get more respect.

Maybe I’m completely wrong!!!  Who cares!!!!  I’m on the team and I literally haven’t been this happy in WELL over a year (maybe MUCH longer if I had the time to really think about it!!  :) )

So, this is how it worked for you 0Ls out there (and maybe some 1Ls who didn’t try out but plan to next year):

About a week after our oral arguments were over and Moot Court was chosen, the flyer was posted to tryout for the Trial Advocacy team (trial team).  There was a case in one of the casebooks in the library that we were to look at.  We were to prepare a 3-5 min opening statement, 3-5 minute closing statement, a direct examination and a cross examination.  The case was about a cop who was murdered and 3 suspects – one given immunity to turn in and testify against the other two.  Remarkably enough, I was so overwhelmed by the whole process, that when a 2L I asked to help me (a cutie-cutie in my class) said he’d take the defense, I just said “yea, me too” without even realizing then that I was defending “cop killers”!!!  I mean it was literally the day of the trial that I thought of the defendants as “cop killers”!!!  How amazing is that?!?!?  And very eye-opening to me because I read the case without understand what happened and since I decided to defend the men I never thought of them as guilty.  I immediately looked for the reasonable doubt and ways to prove they didn’t do it.

Already thinking like a trial lawyer!!!!!!!!  :)

I’m soo glad I didn’t think it through because on the day of the tryouts – of the 45-50 people who tried out, I may have been one of only 10 people who chose the defense!  That certainly had to make me stand out, right???

Plus, I was able to play Johnnie Cochran for a bit and really try to mess with the reasonable doubt thing.  (For those of you young-uns out there, Mr. Cochran was the famous lead attorney for the 1st OJ murder trial – the one where OJ was found not guilty – “If it doesn’t fit, you must acquit!” referring to the famous incident when the prosecutor mistakenly had OJ try on the glove found outside of his home and OJ played it up to show that oh he is trying soo hard but it is just too small to fit on his big strong hands – proving to the jury that it wasn’t OJ’s glove (it could have just shrunk, but the visual was sealed in everyone’s head – CLASSIC!!!!)

But I digress…

So, I had a few OJ/Johnnie Cochran moments in my opening/closing!  I used lyrically speech and made things sound memorable.  Used a theme.

But, I’m jumping ahead of the story…so the time between the tryout sheet being posted and the tryouts was 10 days!!  And remind you, as a 1L, we’ve never taken Evidence and Trial Advocacy so we don’t really know anything more about these things than literally what we’ve seen on tv, for the most part!!  AND, the 2Ls trying out had already had BOTH classes!!!  So, competition was FIERCE!

First thing I did was hit the inter-webs thingee – and went to You Tube.  There I found endless videos of mock trial teams competing, how to write a closing, an opening, etc.  This was GOLD for me because I really  had no idea an opening and closing were really any different (which they are, significantly!!!)  I also learned about things like leading, being argumentative, impeaching a witness, where to stand when doing a cross or direct, using inflection and how to stand while speaking…

OMG – and at that point there was literally 2 days left to prepare!!!!!!

So, day before the try-outs I wrote my opening – morning of the try-outs I wrote my closing – literally about 30 minutes before the try-outs I wrote my questions for the direct and cross.

PLEASE DO NOT PREPARE THIS WAY!!!!!!!!!!

My procrastination is kicking my BUTT right now, so I definitely waited until WAY too late to prepare!!  I was memorizing the opening from noon-3:00 but when I went to practice with my friends, I could barely remember a thing!!!!!  I was devastated!!! 2 hours before tryouts and I couldn’t remember it!!!!

And I think I know why:  the lectern was missing!!!!!!!

The whole time practicing for my oral arguments, you are using a lectern.  This is SOOO different.  You are suppose to move around and get emotional – the OPPOSITE of Appellate advocacy!!!  I stood up in front of that room we were practicing in and as soon as my friend moved the lectern I FROZE!!!  I didn’t know what to do with my hands – I didn’t know where to move to – I was FREAKING OUT!!!!!!

I had been practicing in my chair, in my car, while I was drying my hair, in the shower, but NEVER in the middle of an empty room with nothing in my hands!!!!  PLEASE DO THIS BEFORE YOUR TRYOUTS!!!  MANY MANY TIMES!!!!

So, I spent the next 2 hours pacing the stairwell, memorizing my opening.  Unfortunately I never got to practice again because I didn’t have my questions prepared (again, PLEASE DO NOT PROCRASTINATE!!!!!!), but thank GOD for the way they set up the tryouts!!!

We were split into three groups of 14-16 people.  One group started with opening, one with direct/cross, and one with closings.  We went in the order of a trial which made things nice, but what made it even better is they didn’t put us in any kind of order of who goes first so people sort of started lining up to go in.  Well, since there were at least 8-10 people in line, I decided to walk around and practice my opening sort of out loud.  Many others were doing the same – it was funny!!!

By the time it was my turn, I was pretty confident I would remember what I wanted to say.  Bad thing is – they never let me finish it!!!  I planned on speaking for about 2.5 minutes and I barely got 2 minutes in!!!  My opening built to a great ending!!  I was SOOO pissed!!!  Plus, it was obvious some of the people in the room weren’t paying attention to me (there were like 10 people in one of our larger lecture rooms)!  And one guy even made an old person joke!!!!!!!!!  :(  (they asked when I last did anything like this and I said debate in high school, but that was a long, long time ago.  Guy said “really, not a year or two?”  DICK!!!!  And right before I was to start!)

So, that could have gone better.  I think I spoke well and showed I was comfortable giving the opening.  I looked around the room and used inflection.  I also think I invoked the theme they were looking for.  It wasn’t bad but I am quite sure they saw MUCH better!!!

Then we moved to the direct/cross portion in the courtroom.  That couldn’t have gone worse!!!  I couldn’t read the question – wasn’t sure which one to ask next – didn’t get a chance to get to the good part!  That section went SUPER fast!!!!

So, then it was time for the closing.  Literally, I couldn’t remember most of it!!!!!  I was screwed!!!!  I began pacing the room and memorized the whole thing!  Then, I heard they were going to only give you like 3 minutes so I cut out a bunch of the stuff in the middle!!  Good thing is, that was the stuff I was having trouble remembering.  So, I went in the room – scene of my Contracts class last fall – big room – not warm!  There were like 15 people – the cutie 2L from my class and the Judge that runs the whole program – a legend, really!

Well, I just KNEW I couldn’t blow it now!  A.  I didn’t want to disappoint the guy who helped me so much to prepare.  and B.  The Judge was there and I wanted to make sure he knew what I could offer.  Apparently, many before me went way too fast so they kept telling me to make sure I went slow.  They also said they would give me a 1 minute warning sign.  I told them they would need neither.  The way to calm my nerves was to actually tell my head to speak slowly.  Not sure how I do it but it works!  I use to ramble my speeches in like 30 seconds flat but with practice over the years, I’ve really slowed down!!!

I was more concerned with remember the speech, SOUNDING like it was memorized, and not having enough emotion.  Well, there are rare times in one’s life when it all clicks at the same time, but that was it.  I’m not saying I was the best by any stretch – I’m saying I did the absolute best that I could do and for THAT, I was THRILLED!!!!!!!!  I did exactly what I wanted, I didn’t run out of time, I never was told to slow down, I looked at all of them in the eye, I used inflection, I had emotions, I did ALL that I wanted to do.

Again, was I the best – NOT EVEN CLOSE!!  But, I did what I wanted to do!!  I got a few “Really, Really good job”s from people, including the Judge!!!  One guy asked if I was a day student (which at the time made no sense, but now I realize meant that to be on the team you couldn’t take night classes).  I showed them I could do it!

So, the bad thing is, but buddy from school didn’t make it!!  :(  That really would have made it fun!  I just know that this is going to be the best thing I do in law school!!  Our school is ranked very well for this program so hopefully jobs will recognize the skills I’ll have when graduating so that it’ll make getting a job easier!

And, peeps – it was soooo freaking fun!!!  I mean seriously – I want to do it again – right now!!!!

And I THINK this means I don’t have to try out again for next year’s team which is AWESOME!!!!!

So, yes – I was devastated by not making Moot Court, but once I heard about Trial team I realized this is a much better fit for me anyway!!  I’m never going to be in an honor society for law school but this is what I could be good at – litigation!  I went to law school to be a litigator so I am beyond thrilled by this!!

WOO HOO!!!!

Not sure how it happened – grades not being the best and all – but I received notification last week or so!  Still can’t believe it!  I actually found a former clerk of my Judge from my school so we spoke for a while last week.  She gave me really great pointers!  Good news is, this guy will actually have me researching and writing memos about the cases being heard!

OMG!!!  An actual legal position!  It is just really hard to wrap my mind around!  Spending the summer in a courtroom, writing memos FOR REAL, gaining ACTUAL experience – I could throw up I’m so excited!!!

0L lesson of the day:  APPLY FOR EVERYTHING!!!!!!!!!!!  I had until Dec 31st to apply for this position.  I literally spent New Year’s Eve filling out the application, fixing my writing sample and writing a cover letter!  I hit send at 12:02am!  (I know – turning things in late has become a pattern of mine – I’m thinking self-sabotage for some reason – fear of success – who knows!!

but I digress…

I decided after finals that I wouldn’t apply because there was NO WAY my grades would be in the upper 25%, but then literally New Year’s Eve day I said “what the fuck – just do it!”  Thankfully, I have no life or plans on New Year’s Eve so I was available to still send it and thankfully they allowed the 2 minute tardiness.

Here’s the thing – I have always felt that I wanted to be a lawyer in my heart!  I actually enjoy the majority of the classes I’ve taken.  I LOVE the idea that each day I get through, I am one day closer to actually becoming a lawyer!!!

But, last semester was SOOO hard and even though I could have done a lot more preparation for finals, I still felt I would have done better than I actually did.  I was devastated when I got my grades because for a law student, it is LITERALLY all about 1L grades!  And to not put yourself in a hole, 1st semester grades are WAY more important than they should be considering we have NO idea how to do this law school thing!!!!

So, although my heart wants to be a lawyer, this was the first time in my life that I worried that even if I tried my best I still wouldn’t be allowed to do this and I wouldn’t make it.  I have sacrificed SOO much to be here and the thought of not being successful is mortifying!

Now, here’s the thing – I’ve never actually given this law school thing even close to 100% effort!  I bet I haven’t given it more than 60%.  It’s not because I’m a slacker or think I can slide by – it’s really because I have soo much on my plate I look for short cuts every where and try to “just get by”!

Well, again, for the first time in my life, you cannot “just get by” here!  There is WAY too much information – it is WAY too hard and the people here are WAY too smart!!!  This place does not allow you to have even a weekend off without losing ground!  (And I’ve taken MANY weekends off this semester for family stuff!!)  So, now I’m scared that I’ve run out of time to catch up.  I spent much of the weekend with Civ Pro and feel better about what I’ve done but I am WAY off from where I need to be!!!!

This is rambling, I know!  Sorry!  I guess my MAJOR point is this – I REALLY WANT THIS!!!  Getting that clerkship proved to me that I MUST start taking this shit seriously!!  I’ve got a back up system in place at my home w/ the kids, work is on board – I am just letting all of it stand in my way!  I truly believe I am afraid to succeed and that seems soo ridiculous to me, but why else would I be sabotaging myself???  I KNOW there are a TON of people here WAY smarter than me, but I also know that I haven’t been giving it my all and I am curious to see how I can compete when I DO give it my all!!!

So, hopefully it is not too late to get in the game this semester!  I did not make Moot Court through oral arguments SIMPLY because I didn’t practice enough!  People practiced every day for 2 weeks – I practiced once!!!

WTF!!!

When I spoke with my Prof he basically told me I just needed to practice more!  Funny thing is, I knew my grades weren’t going to get me in and if I made it in through oral arguments they would have denied me for grades, so maybe I sabotaged my oral arguments so I wouldn’t have to be disappointed later!?!?!  All I know is if I would have done better last semester (just by a little bit) I would have had a much better chance to make it!!!

So, I have already changed my mindset.  I am sick of feeling sorry for myself or worrying about my personal life – get over it already!!!
